The terms that govern our working relationship.

Overview

These terms and conditions govern the provision of website design, development, and maintenance services by Velo Websites ("we", "us"), a sole trader business operated by Alfie Skeet, to you ("the client"). By engaging our services, you agree to be bound by these terms.

Services

We provide website design, development, and ongoing maintenance services as described in our packages on velowebsites.io. The specific scope of work will be agreed in writing (by email or a formal proposal) before any work begins. Any work requested outside the agreed scope may be subject to additional charges, which we will discuss with you in advance.

Quotes and pricing

All prices listed on our website are in British Pounds (GBP) and are inclusive of VAT where applicable. Quotes are valid for 30 days from the date they are issued. We reserve the right to adjust pricing for new projects, though the price agreed in your quote will be honoured for your project.

Payment terms

A deposit of 50% of the agreed project fee is required before any work begins. The remaining 50% is due upon completion of the project, before the website is made live on your domain.

All invoices are payable within 14 days of the invoice date. We reserve the right to charge interest on overdue payments at a rate of 4% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

We accept payment by bank transfer. Payment details will be included on each invoice.

Design and approval process

We will provide a design mockup for your approval before development begins. Revisions at the mockup stage are included as specified in your chosen package. Once you approve the design in writing (by email), we will proceed with development. Any significant design changes requested after approval may incur additional charges.

Project timelines

We aim to deliver your website within 14 days of design approval, as stated on our website. This timeline depends on timely feedback and content from you. Delays caused by late provision of content, feedback, or approvals may extend the delivery timeline. We will keep you informed of progress throughout.

Client responsibilities

You are responsible for providing us with any content, images, logos, branding guidelines, and login credentials needed to complete the project, in a timely manner. You confirm that any content you provide is owned by you or that you have the right to use it, and that it does not infringe on any third party's intellectual property rights.

Intellectual property

Upon receipt of full and final payment, ownership of the custom website design and content created specifically for your project transfers to you. Until full payment is received, all intellectual property rights remain with Velo Websites.

We retain the right to display the completed website in our portfolio and marketing materials unless you request otherwise in writing. Any third-party assets used in your website (such as stock images, fonts, or plugins) remain subject to their respective licences.

Refunds and cancellation

Once work has commenced on your project (following receipt of the 50% deposit), no refunds will be issued. The deposit is non-refundable as it covers the time and resources allocated to your project.

If you wish to cancel your project before any work has begun, you are entitled to a full refund of any deposit paid. Cancellation requests must be made in writing to [email protected].

Velo Care Plan

The Velo Care Plan is a monthly hosting and maintenance subscription at £60 per month. It includes hosting, SSL certificate, daily backups, WordPress and plugin updates, speed monitoring, security protection, and minor content changes as described on our website.

The Care Plan is billed monthly and can be cancelled by providing 30 days' written notice. Upon cancellation, we will assist with migrating your website to your chosen hosting provider if requested, though migration support is not included in the plan and may incur a separate fee.

The Care Plan does not cover major redesigns, new page creation, new feature development, or recovery from damage caused by unauthorised modifications to the website. These are available as additional services at our standard rates.

Website hosting and third-party services

If you are on the Velo Care Plan, we manage hosting on your behalf. We use reputable third-party hosting providers and take reasonable measures to ensure uptime and performance, but we cannot guarantee uninterrupted service and are not liable for downtime caused by third-party providers, server failures, or events outside our control.

Limitation of liability

To the fullest extent permitted by law, Velo Websites shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

Our total liability to you in respect of any claim arising out of or in connection with our services shall not exceed the total amount paid by you for the specific project or service giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Confidentiality

We will treat all information you provide to us as confidential and will not disclose it to third parties except where necessary to deliver our services (for example, to hosting providers) or where required by law. This obligation survives the termination of our working relationship.

Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. For ongoing services such as the Care Plan, we will notify you of any material changes by email at least 30 days before they take effect.
